CHICAGO (WBBM NEWSRADIO) -- A driver said brake problems caused him to hit a flock of Canada Geese on the North Side this week.  Witnesses said it was deliberate.

Oscar Russell Jr. said bad brakes led his Jaguar to hit a flock of Canada Geese in the Lathrop Homes housing development on the Near North Side on Wednesday.

Six geese died.  But witnesses took to social media to say it was intentional.

Annette Prince, director of Chicago Bird Collision Monitors, told CBS 2 the geese are federally protected.

"Anyone with malicious intent harms them is committing a federal crime," she said.

Russell said he's sorry for what happened.  The Chicago Department of Animal Care and Control cleared the scene.  The U.S. Fish and Wildlife Service could pick up the case.
