GARY, Ind. (WBBM NEWSRADIO) -- The city of Gary has won a round in court in a long-running lawsuit against a gun shop and manufacturers.
Lake Superior Judge John Sedia ruled that the city can subpoena sales records from Westforth Sports and other gun shops as it seeks to determine how guns are ending up being used in crimes.
The city of Chicago sued the shop over alleged straw purchases two years ago, contending it was the third largest supplier of guns used in crimes.
That case was recently dismissed over jurisdictional issues. A judge said purchases were made in Indiana, not Chicago.
The Gary suit said the shops and manufacturers should be considered public nuisances. The Gary Post Tribune reports both called the suit, initially filed in 1999, "a fishing expedition."
The suit has survived multiple challenges.
