Attorney for man accused or murdering teen girl in 1972 wants him released under SAFE-T Act

(WBBM NEWSRADIO) -- The attorney for a man accused of the 1972 killing of a teenage girl wants his client released from jail under the new SAFE-T Act rules.

Barry Lee Whelpley is accused in the stabbing death of 15-year-old Julie Ann Hanson, whose body was found in a field near 87th and Modaff Road in Naperville.

Whelpley’s defense attorney, Terry Ekl, recently filed a motion to vacate his bail. In a statement to NBC 5, he said that Whelpley has been charged with a murder that took place nearly 50 years ago and "there’s no evidence he’s engaged in any recent criminal conduct."

Whelpley's bond was set at $10 million, but under the SAFE-T Act that goes into effect in January, judges would have discretion on whether individuals accused of violent crimes should be detained before trial.
