(WBBM NEWSRADIO) — Charges have been dropped against a Northwest Indiana couple accused in October of murdering their children.

Both the prosecution and the defense filed motions to dismiss all charges against Steven Valle and Samantha Sebella.

Defense attorney Mark Van Der Molen said there’s no evidence that a crime had been committed.

It was alleged they buried the bodies of two children in their yard in Wheatfield and later burned the remains.

There were incriminating text messages. Bones discovered in a burn pit turned out to be animal bones.

Van Der Molen told the Times of Northwest Indiana the charges were triggered by a drunken Steven Valle making ridiculous statements to a friend after Sabella had two miscarriages.

Prosecutors could re-file charges, should new evidence come to light.
