CHICAGO (WBBM NEWSRADIO) — What’s in a name? Or, in this case, what’s in Buffalo Wild Wings’ boneless wings?
Aimen Halim ordered the menu item from a Mount Prospect location in January 2023, thinking he was exclusively getting chicken wing meat.
The Chicago resident claimed he suffered financial injury after learning the restaurant’s boneless wings are instead slices of chicken breast that are deep-fried, which he said are nothing more than nuggets. Now, Halim is taking the Georgia-based company to court.
“Had Mr. Halim known that the Products are not chicken wings, he would not have purchased them, or would have paid significantly less for them,” the suit reads. “As a result, Mr. Halim suffered a financial injury.”
In the 22-page class-action lawsuit, filed in the U.S. District Court of Northern Illinois, Buffalo Wild Wings is accused of false and deceptive marketing and advertising.
The restaurant chain posted a statement to Twitter about the lawsuit:
According to court documents, several of Buffalo Wild Wings’ competitors are careful to name their products “Boneless Chicken” or “Chicken poppers,” rather than “Boneless Wings,” to prevent consumers from being misled.
Lawyers for Halim argued that if Buffalo Wild Wings fails to fix the alleged false advertising, then it would amount to an “ongoing injury” against Halim, due to his “desire to purchase the Products in the future.”
