
(WBBM NEWSRADIO) — Checks of nearly $400 could soon be sent to more than 1.5 million Facebook users from Illinois, after a federal appeals court upheld a settlement in a class-action privacy lawsuit.
Attorney Jay Edelson flied the lawsuit accusing Facebook of violating an Illinois law that requires companies to get permission from customers before using facial recognition technology to identify them.
The appeals court rejected claims by two people who were part of the lawsuit who said too much of the money was set aside for legal fees.
Edelson says they could appeal to the U.S. Supreme Court, but he doesn't expect that will happen. Barring a delay, people will receive their money in the next 60 days, he said.
Edelson said the settlement is a victory for everyone, because it has led Facebook to change its policies and will encourage other tech companies to respect the privacy of customers.
