
(WBBM NEWSRADIO) — The family of an Elk Grove man shot and killed by police late last year has filed a wrongful death lawsuit against the village and five officers.
The civil suit accuses the unnamed officers of willful and wanton conduct, and battery in the shooting death of Jack Murray in December of last year.
Speaking at a downtown law firm, Donna Murray said her son was emotionally distressed when he called police that night.
“We as a family never anticipated that Jack's cry for help would lead to deadly shooting and the loss of our 24-year-old son and brother.”
Attorneys for the family contend officers had prior contact with Murray and should have known he had such episodes. The suit also contends police failed to use de-escalation tactics.
About two weeks after the shooting, the village said officers used a taser on Murray who continued to walk toward them holding a knife and released body cam video in support of that claim.
Elk Grove Village has issued the following statement in response to the lawsuit:
The Village is aware of the lawsuit filed by Mr. Murray’s family and will review it upon receipt of the complaint in order to determine how best to move forward.
The Village once again expresses its sincere condolences to the Murray family for its loss.
The officers who responded to this incident all have received combination of crisis intervention training, mental health training and de-escalation training, all of which were utilized in response to the incident involving Mr. Murray.
The Village looks forward to defending the actions of its officers during the very unfortunate and tragic incident involving Mr. Murray.
