Federal judge decides not to block Illinois' assault weapons ban

(WBBM NEWSRADIO) -- A federal judge has declined to block the state’s ban on certain types of firearms.

Judge Virginia Kendall ruled that the ban passed by Illinois lawmakers is “constitutionally sound” and so is a similar ban passed by the Naperville city council.

The National Association for Gun Rights and attorneys for Robert Bevis, owner of a gun store in Naperville, are challenging the bans.

Arguments centered on a Supreme Court decision that found that restrictions on weapons must be limited to dangerous and unusual arms that aren’t commonly used.

When Naperville passed the ban, Bevis said these aren’t unusual weapons.

"You just take away the AR-15. The AR-15 is the most popular rifle there is," he explained.

"A lot of people like it. It's like telling McDonald's that they cannot sell hamburger meat anymore in their store, but go ahead and sell anything else you want."

Bevis' attorneys made the same argument.

The judge wrote: “The text of the Second Amendment is limited to only certain arms, and history and tradition demonstrate that particularly ‘dangerous’ weapons are unprotected."
