
CHICAGO (WBBM NEWSRADIO) -- Cook County State's Attorney Kim Foxx’s top assistant is resigning after an investigation of misleading statements made in connection with the shooting of 13-year-old Adam Toledo.
The questionable statements were made at a bond hearing for 21-year-old Ruben Roman, the man accused of giving 13-year-old Adam Toledo the gun he was carrying.
An assistant state's attorney read a statement in court that left the impression that Adam was holding the gun at the time he was shot by a Chicago police officer. Police body cam video showed he tossed it away a second beforehand.
An internal investigation ordered by Cook County State's Attorney Kim Foxx said "the language the attorney used in court was inartful, leaving an unintended impression" and the assistant “did not intend to give the impression that Adam Toledo was holding a gun when shot."
The report blames a "breakdown of communication" for how the matter was handled and Foxx in her statement said "the tragedy of the death of 13-year-old boy has been clouded by the confusion and frustration my office has caused and for this I apologize. It’s not lost on me that our community is grieving and I want to assure Adam’s family and the public that my office is working diligently to investigate his death.”
Additionally, the Cook County State's Attorney's Office said attorneys within the office will undergo training about presenting facts in court to support the charges at issue; and additional office policies and procedures have been and will be implemented to ensure “checks and balances” operate as intended.
Attorney James Murphy, who made the statements in bond court, has returned to his assignment and is no longer on leave.
Before this statement was issued, First Assistant State’s Attorney Jennifer Coleman, Foxx's second in command, reportedly resigned. Foxx made the announcement separately in an internal email to staff.
