Geneva man’s lawsuit claims he contracted Legionnaires’ disease from senior living facility

CHICAGO (WBBM NEWSRADIO) — A 70-year-old Geneva man is suing a senior living facility for allegedly giving him Legionnaires’ disease — but not as a resident.

Terry Irvin would drive past Covenant Living at the Holmstad on his way to work.  His lawsuit against the Batavia facility claimed Irvin contracted Legionnaire’s disease in September of 2019 from vapor released from a contaminated cooling tower.

The Kane County Chronicle quoted his attorneys as saying the Illinois Department of Public Health confirmed Irvin was one of 14 cases from an outbreak at Holmstad that included another community member.

Irwin is seeking $50,000 in the suit that accuses Covenant Living of failing to properly clean its tower, despite being told by the state it had bacteria. The facility declined to comment citing the pending litigation.
