
(WBBM NEWSRADIO) – A federal judge for the Southern District of Illinois on Friday granted an injunction to suspend parts of the new Illinois assault weapons ban.
Judge Steven McGlynn ruled that the parts of the law known as the Protect Illinois Communities Act cannot be enforced as the statute is challenged in court.
In a 29-page opinion, McGlynn wrote that the “senseless crimes of a relative few” cannot be used to justify restricting constitutional rights of law-abiding citizens.
The law bans the sale of certain weapons and attachments. It was passed in response to last summer's deadly Fourth of July parade shooting in Highland Park.
The court’s ruling will allow gun shops to sell assault weapons and attachments, but other provisions are unaffected by it.
Gov. JB Pritzker's administration is expected to file an immediate legal challenge.
