(WBBM NEWSRADIO) --The Lake County, Indiana Prosecutor has asked the State Police to investigate the incident in late July when 10 German Shepherds being transported from O’Hare to a training facility in Michigan died of heat stroke.

Just after the incident occurred, Lake Station Police called it a “freak event,” and said the man transporting the dogs was not at fault.

Mike McHenry, a retired police officer and K-9 trainer, told police the air conditioning in the box truck failed.

Jenny Webber, Executive Director of the Humane Society of Hobart responded to a gas station where McHenry stopped the truck after hearing the dogs barking and she said she was prevented by police from treating the dogs, at McHenry’s request.

He was allowed to leave with some of the dogs, dead and alive.

Daphna Nachminovitch, with PETA, was among those calling for an independent investigation.

"Here you have a humane society that is contracted to do their job and the people who are equipped to render emergency aid to these dogs are made to stand by as these animals are actively dying and in heat stroke, every second counts," she said.

Nachminovitch said the state police investigation “a step in the right direction.” State police would like to hear from anyone with information about the incident.
