Judge tosses metal-shredding firm's suit against Chicago

CHICAGO (AP) -- A federal judge has tossed out a lawsuit filed against the city of Chicago by the owner of a metal-shredding facility seeking to operate in the city.

Southside Recycling wanted the federal court to force Chicago to issue a permit that would allow the company to open a facility in a Southeast Side neighborhood.

U.S. District Judge Robert Dow Jr. on Tuesday rejected the company's claim its constitutional rights are being violated by Mayor Lori Lightfoot's administration is withholding a  permit while environmental studies are conducted.

Junked automobiles, used appliances and other metallic waste would be shredded at the plant.

The largely Latino opponents of the plant say granting a permit to Southside Recycling would amount to environmental racism.
