HINSDALE (WBBM NEWSRADIO) - The DuPage County state's attorney has decided not to charge a teen driver with the death of a Hinsdale boy this summer after the Jeep he was driving crashed into a sub shop.
Investigators found the 16-year-old employee of Fuller's Car Wash did not intend to hurt anyone or engage in reckless driving. After reviewing blood and urine samples, as well as the Jeep's black box they found back in July, the teen stepped on the gas thinking it was the brake and the Jeep's automatic braking engaged after hitting Sean Richards.
The 14-year-old died and three other people were injured.
The state's attorney's office said the teen will be cited for failure to exercise due care and two other traffic tickets in what it calls a tragic accident.
