HAMMOND, Ind. (WBBM NEWSRADIO) -- Hammond Mayor Thomas McDermott has lost his fight to keep the emergency room at the Franciscan Health hospital open.

The Indiana Court of Appeals overturned a lower court order and now the ER is closed as of today as originally planned.

“As most ambulances have already stopped bringing patients to Franciscan Health Hammond, we do not expect that closing the Emergency Department will cause disruption in emergency medical care for residents," Franciscan Health said in a statement.

McDermott called this an "absolute betrayal." Fraciscan had earlier said it would keep the ER open at the 124-year-old hospital, originally called St. Margaret’s.

“It’s shocking to me," he told the Times of Northwest Indiana. "The Court of Appeals didn’t even give us a hearing. It was all one-sided.”

McDermott said Franciscan is " just evil.”
