Indiana senator says states should decide contentious topics, including interracial marriage – then walks the comment back

(WBBM NEWSRADIO) — One of Indiana's U.S. senators is making news, following his response to questions about the Supreme Court.

Republican Mike Braun told Indiana media outlets on a conference call that the high court should vacate past rulings dealing with the legality of controversial subjects, including abortion and marriage rights.

A reporter for the Times of Northwest Indiana asked for clarification.

“So, you would be okay with the Supreme Court leaving the question of interracial marriage to the states?” the reporter asked.

“Yes,” Braun replied. “I think that that’s something if you’re not wanting the Supreme Court to weigh in on issues like that, you’re not going to be able to have your cake and eat it, too. I think that’s hypocritical.”

Braun acknowledged that rights would vary from state to state, but called that the beauty of the system.

The senator later said he had misunderstood the question. His office issued a statement that said, in part: "... let me be clear on that issue -- there is no question the Constitution prohibits discrimination of any kind based on race."

Braun said he has not decided on whether he would vote to confirm Judge Ketanji Brown Jackson, President Biden’s choice for a Supreme Court seat.
