Suit: Combat veteran's image appears in poster without his consent

A lawsuit filed against Walmart, Amazon and other businesses accuses them of profiting from photos of U.S. combat soldiers, including a veteran from Niles, that were put on posters without their consent.

Nick Giovannelli, a decorated Army combat veteran, learned from a friend that his images are on the posters.

His attorney, Craig Tobin, on Thursday said the photos, taken by the Army, were never intended to be sold commercially.

“We became involved, somewhat shocked and surprised that major corporations in this country would exploit the service of people like Nick and do it for their financial gain,” Tobin said.

Giovannelli, who served multiple tours in Afghanistan, was medically discharged in 2015 after sustaining a traumatic brain injury. The plaintiff is seeking financial compensation and an end to the sale of the posters.

Walmart says it has not seen the suit; Amazon has not commented.
