ORCHARD PARK, N.Y. (WBEN) - If there cannot be any fans at Buffalo Bills games this season, don't expect there to be any tailgating outside the stadium in any of the private or commercial lots.

That was the conclusion drawn from Wednesday's town board meeting in Orchard Park. Councilman Conor Flynn told WBEN the Erie County Department of Health will not allow tailgating if fans cannot go into the stadium.

"Any resolution that we might have been working on is a moot issue at this point," Flynn said. "We will re-visit it in the future if necessary. We'll be taking guidance from the department of health. As I've said before, our first and foremost concern is keeping our residents here safe. We are happy to work with them to make sure that that is in fact the case."

Orchard Park leaders did vote to have a public hearing on September 2 on a policy related to buses at private lots. There is a moratorium on party buses in private lots. The town is looking to permanently ban these buses on private lots.
