Buffalo, NY (WBEN) The man accused of shooting up a Dollar General in Cheektowaga two years ago is declared unfit to assist in his defense.

Flynn says conditions at the holding center are not conducive for Green, but that's not the fault of deputies. "He allegedly assaulted a sheriff's deputy while in the holding center, and as a result he was put in isolation for extended periods of time," explains Flynn. "Obviously being in isolation is not helpful, but he was not taking his meds. Those in the holding center can't force him to take his meds, they can in Rochester though." Green will be under constant treatment and care in Rochester, adds Flynn.

Flynn says he wants Green to be able to assist in his defense and get a fair trial. "I also want justice, so I will wait for justice," says Flynn.
