BUFFALO, N.Y. (WBEN) - Governor Andrew Cuomo questioned whether Erie County Executive Mark Poloncarz has the right to mandate vaccines in order to attend a Buffalo Bills home game in the fall.

"I don't think the county executive is legally correct," Cuomo said. "Besides that, we tend to work in a collaborative with local government. We're just not there yet to make those decisions."


Poloncarz on Tuesday announced that all attendees at a Bills home game must get vaccinated and prove they have been vaccinated using the Excelsior Pass app.

Cuomo said it's too soon to make a decision on whether the vaccine passports will be required. The Bills season is due to begin in September.

"You have to see where you are," Cuomo said. "Things change so quickly. Where are you going to be in four months? I'll tell you in four months. If the immunization goes all right and there's no variants of interest and if, God forbid, there is not another virus or pandemic. I think it's early to make a decision months ahead."

Cuomo, and his acting counsel, Beth Garvey, said the state would need to sign off on the idea.
