Buffalo, N.Y. (WBEN) - It was during a press conference he was participating in when Buffalo Police Commissioner Joseph Gramaglia learned from Erie County District Attorney John Flynn that bail was set for a 14-year old charged in connection with a weekend homicide.

Flynn disclosed the development as he opened his remarks during an afternoon briefing and said a 17-year old has been remanded to custody in connection with the shooting incident that claimed the life of a 16-year old victim.


The two juveniles face charges of Murder in the Second Degree and Attempted Robbery in the First Degree. Both suspects appeared Monday before Erie County Family Court Judge Brenda M. Freedman for a bail hearing where the 17-year-old was remanded and the 14-year old was set bail of $50,000.

Both Flynn and Gramaglia expressed frustration at the bail after requesting that both suspects be remanded. "You can ask the judge why," said Flynn. "I get no pleasure from putting a 14-year old in jail. But it needs to be done."

Gramaglia also expressed concern over the granting of bail, saying, "Nobody has a fear of any consequence." He says when there is little or no consequence, those responsible return to the streets and engage in gun violence.

It is alleged that just after midnight on Friday, August 19, the juveniles attempted to rob a 20-year-old male who was in a vehicle and in the course of the attempted robbery a 16-year-old female passenger was shot and killed on Elmer Avenue in the City of Buffalo.

The case is set to return on Friday, August 26, 2022 at 11:15 a.m.
