Buffalo, NY (WBEN) A former Erie County Legislator is charged with harassment after prosecutors say she filmed a person filling out her ballot during early voting in October.

Erie County District Attorney John Flynn says Betty Jean Grant videotaped an elderly woman while she was filling out her ballot during the October 23rd early voting at the Delavan Grider Community Center. "She was charged with harassment because the victim, an elderly woman, felt annoyed and harassed. This woman is very upset about this, as is her daughter who lives in Washington, DC, who saw this on Facebook. The family is outraged by this," says Flynn.

Flynn says Grant thought the person helping the victim was an elections employees.

"The woman was randomly there voting did not volunteer to help the elderly lady out. The elderly lady asked for help," explains Flynn. "Technically, you're supposed to go to an elections worker and ask for help. She is an elderly woman, and she turned to the first person she saw and said I can't see this, I can't read this, can you help me out. That woman helped her out, and that's when allegedly Betty Jean Grant thought something funny was going on, and took it upon herself to videotape this."
