Judge rules against stopping Great Northern demolition

Tielman says this opens the door for an appeal to keep the elevator standing

Buffalo, N.Y. (WBEN) - Preservationist Tim Tielman says he's glad his petition to stop demolition of the Great Northern Grain Elevator was dismissed Thursday. Tielman says that's because he can now appeal the ruling.

"It's about time," says Tielman of Judge Emilio Colaiacovo's ruling dismissing his petition. "That enables the Campaign for Greater Buffalo to appeal the decision to demolish the Great Northern Grain Elevator. It's something we've been waiting for, actually since July 5," explains Tielman. He says Colaiacovo did not dismiss the case when he lifted the temporary restraining order on demolition.

With equipment at the site, Tielman knows demolition could begin at any point. He says trying to save it is an urgent matter. "We are going to run as fast as humanly possible to the appeals court with an order to show cause and hopefully get a temporary restraining order until our case can be heard," says Tielman.

He believes while owner ADM could go ahead with demolition, any such move would not sit favorably with any court.

Tielman says he's hopeful an appeals court will rule in his favor and keep the grain elevator standing. "We think when we get into a the a truly neutral body that examines all of the evidence that is available, that the court will agree with us as they agreed with us once before unanimously, back in April," says Tielman.
