BUFFALO, N.Y. (WBEN) - Another lawsuit has been filed challenging New York State's COVID-19 mandates.
The latest suit, filed by HoganWillig, is seeking to overturn the universal masking mandate for children, teachers, and staff in grade schools.
"Unfortunately, and incredibly, with the appearance of the COVID-19 virus in late 2019, the basic principle of separation of powers has seemingly vanished," Corey J. Hogan, lead attorney on the case, said in a statement. "Throughout this country, the legislative and judiciary branches have stepped back and allowed the executive branch at all levels of government to assume sole control of all government functions when it has any association with the COVID-19 virus and taken fundamental decision-making away from the individual."
Petitioners include individual parents, State Senator George Borello, Niagara County Legislator John Syracuse, St. John Lutheran Church and School, and parent groups. They're advocating for parental choice regarding masking children in schools. They want New York State to provide definitive policies. The petitioners also believe that because long-term impacts of masking kids are unknown, the choice should be left to parents and individuals.
