Buffalo, NY (WBEN) A Town of Tonawanda man will spend a year in jail after his gun discharged while in a restaurant with his girlfriend. Part of the sentence also comes from a drug possession conviction.
20 year old Anthony Ciccarelli pleaded guilty to attempted criminal possession of a weapon after a handgun in his pocket went off inside a restaurant at Walden Galleria. His girlfriend was shot in the leg. The handgun was reported stolen from a vehicle in Niagara Falls and was not registered to Ciccarelli.
While waiting sentencing on this case, Ciccarelli was arrested in a drug case in Cheektowaga. In that case, police approached a vehicle parked on Shanley Street last October and smelled the odor of marijuana. Ciccarelli, who was sitting in the driver's seat, admitted to smoking marijuana. He was ordered to exit the vehicle as officers conducted a search. The officers found a small quantity of marijuana and $769.00 in cash on Ciccarelli. Officers recovered more than ½ ounce of powder cocaine and a scale from under the driver's seat of the vehicle.
Ciccarelli pleaded guilty to one count of criminal possession of a controlled substance.
