Police investigate pair of fatal accidents

A 22-year-old man has been arraigned for his alleged involvement in a fatal crash in Buffalo

Buffalo, N.Y. (WBEN) - Police in the City of Buffalo and the Town of Cheektowaga are investigating a pair of separate fatal accidents late Tuesday night and early Wednesday morning.

Buffalo Police were called to the scene of a fatal accident that occurred just before 9:45 p.m. ET on Tuesday at Main Street and West Utica Street.

Accident investigators say a 58-year-old female pedestrian, identified as Clara Gomez, was struck by a vehicle and was declared deceased at the scene.

Then on Tuesday afternoon, the Erie County District Attorney's Office announced the arraignment of 22-year-old Marlon D. Servance, Jr. before a Buffalo City Court judge on one count of Criminal Possession of a Weapon in the Second Degree (Class “C” violent felony) and one count of Reckless Endangerment in the First Degree (Class “D” felony).

It is alleged that at approximately 9:43 p.m. ET, the Servance intentionally fired multiple shots from an illegal handgun at another person, which created a grave risk of death to another person. The alleged crime occurred while both the defendant and the victim were driving separate vehicles on Jefferson Avenue and Best Street in the City of Buffalo. The defendant allegedly pursued the victim onto Main Street.

It is further alleged that during the pursuit, Gomez was hit by a vehicle that killed her on sight.

Servance is scheduled to return for a felony hearing before Buffalo City Court Judge Gary Wilson on Friday, May 26, 2023 at 9:30 a.m. ET. He was held without bail.

If convicted of the highest charge, Servance faces a maximum sentence of 15 years in prison.

At this time, the alleged shooting and the fatal crash remain under investigation and additional charges may be filed.

Police say the vehicle involved in the incident has been impounded at this time.

Meanwhile, Cheektowaga Police are looking into a fatal motorcycle accident that took place on the Eastbound Kensington Expressway ramp at around 1:11 a.m. ET on Wednesday.

According to police, a 23-year-old male lost control of his 2001 Yamaha motorcycle and crashed near the I-90 overpass, killing him at the scene.

Route 33 East was shut down between Pine Ridge and Union Road for the crash investigation. Cheektowaga Police says it is still an ongoing investigation.

The U-Crest Fire Department, New York State Police, NFTA, Lancaster Volunteer Ambulance Corps and NYS Department of Transportation assisted at the scene of the accident.
