Cuomo asks judge to toss out retaliation claims lawsuit filed by state trooper

NEW YORK (WCBS 880) — Former Governor Andrew Cuomo is attempting to get two claims of sexual harassment against him filed by a New York state trooper tossed out, according to court documents filed in Brooklyn Federal Court on Tuesday.

In the initial lawsuit filed by the trooper against Cuomo in February, she says the disgraced governor made unwelcome sexual advancements while she was working on his security detail.

The suit also alleged Cuomo retaliated against the topper by threatening “criminal charges against his victims and ethics charges against their attorneys.” Cuomo’s spokesperson, Rich Azzopardi, was also named in the legal documents claiming he retaliated against her by saying her lawsuit was a “cheap cash extortion.”

On Tuesday, Rita Glavin, Cuomo’s layer, filed the legal papers which said Cuomo could not have retaliated against the trooper because he was not governor when her sexual harrassment suit was filed.

Glavin added that the trooper can not prove the claims and the suit should be tossed out. But Valdi Licul, the alleged victim’s lawyer, is arguing otherwise.

“The former governor’s proposed motion is baseless. Our discrimination laws protect victims who have the courage to speak out about sexual harassment,” Liculi said.

According to the legal documents, the trooper, who is not identified, was “violated” multiple times by the governor after transferring to his security unit in January 2018.

The trooper claims Cuomo ran his fingers from her belly button to her holstered gun in one instance and in another he told her she was too old for him in another. The state trooper was allegedly afraid of being booted from the unit if she rejected Cuomo’s advancements.

During Attorney General Letitia James’ five-month investigation into the sexual assault allegations against Cuomo, the state trooper was one of 11 women who testified. After the probe, James published a 165-page report on the accusations after which Cuomo resigned though he denied all claims against him.
