Buffalo, N.Y. (WBEN) - If you ask Rep. Chris Jacobs about his vote this past week on the floor of the House of Representatives not to certify the Presidential election results in Arizona and Pennsylvania, he would tell you it was largely to protect the Constitutional role that state legislatures have in the election process.

It is somewhat ironic now that seven Democratic members of the Western New York New York State Legislature have fired off a letter asking for Jacobs to resign because of that vote.

Jacobs told WBEN Sunday on the Hardline program that his decision to reject certification in the two states followed a great deal of Constitutional consideration and input from legal experts.

"Prior to the 2020 Presidential election, many of the states in question changed the rules significantly without the approval of the legislature," explained Jacobs. Jacobs says his vote to reject the results in those two states was specifically because changes were made to election procedures without the consent of their state legislatures. "I thought it was very clear there was a violation."

In the letter circulated on Twitter Sunday by Assemblyman Pat Burke, seven lawmakers state that Jacobs "cast his vote against democracy and in favor of perpetuating a dangerous lie."

The letter calls for Jacobs voluntary resignation and also states, "If he will not do so voluntarily it is our hope that he is expelled from Congress, consistent with the rules of that body."

The letter is signed by Burke, Assembly Majority Leader Crystal Peoples-Stokes, Senators Sean Ryan and Tim Kennedy along with Assembly members Monica Wallace, Karen McMahon and Jonathan Rivera.
