
There is a recommendation of zero time behind bars for the man who admitted to stealing a pair of ruby slippers from the Judy Garland Museum in Grand Rapids.
76-year-old Terry Martin is in a wheelchair and using an oxygen tank, and prosecutors say his health is too fragil for him to go to prison.
The information was in court documents released this week in Duluth.
Martin admitted in court last year that he used a sledge hammer in 2005 to smash the glass case containing the prop footwear worn by Garland in the 1939 movie "The Wizard of Oz."
The shoes were missing for decades and are still in the hands of the FBI after they were found in 2018.
Martin's sentencing hearing is January 29th in Duluth.
The FBI is withholding comment until after the sentencing.
