
Third-degree murder charges are now filed against the man who drove into a crowded restaurant patio in St. Louis Park, killing two and inuring several others.
Tests showed 56-year-old Steven Frane Bailey's blood alcohol level was three times the legal limit when he drove into the outdoor dining area of the Park Tavern.
The amended charges come after the Hennepin County Attorney's Office reviewed additional video evidence of the Sept. 1 incident in which Kristina Folkerts and Gabe Harvey were killed.
Both were 30 years old.
Folkerts was a server working her shift at the bar when the crash happened.
Harvey was a patron who worked at nearby Methodist Hospital.
Bailey, who's been in custody since the night of the crash, still faces two counts of Criminal Vehicular Homicide and nine counts of Criminal Vehicular Operation.
A preliminary breath sample showed Bailey had a blood alcohol level of .325. The Park Tavern closed for two days after the crash.
