Minnesota Secretary of State Steve Simon says more than 1.7 million absentee ballots have been accepted ahead of Tuesday's election. That means nearly 339,000 absentee ballots that were requested have not yet been returned.
A federal appeals court ruled last week that the state cannot count absentee votes for President after 8pm Tuesday, even if the ballot was postmarked on election day or before.
Simon continues to urge people who still have an absentee ballot to drop it off in person, or go vote in-person on election day.
Simon says his number-one goal is to ensure all legally cast votes are counted.
"That might mean showing up for post-election litigation initiated by someone else who wants to invalidate those ballots," Simon said.
