Family of toddler burned by McDonald’s chicken nugget awarded $800,000

A Florida family has been awarded $800,000 in a civil suit filed against McDonald’s after they claimed that one of the restaurant’s chicken nuggets caused severe burns on their toddler.

Audacy reported about the lawsuit in May when the family alleged that the incident left their daughter “disfigured and scarred.” The incident in the lawsuit occurred on Aug. 21, 2019, when Philana Holmes’s daughter was just 4 years old.

“The Chicken McNuggets inside of that Happy Meal were unreasonably and dangerously hot...and caused [the victim]’s skin and flesh around her thighs to burn,” the lawsuit claimed.

McDonald’s refuted the claim, but the jury found in May that the franchise owner, Upchurch Foods, was liable for failing to warn or provide reasonable instructions on the possible harm of the food.

On Wednesday, the jury awarded the family a total of $800,000 for their pain, suffering, mental anguish, disfigurement, inconvenience, and loss of capacity for enjoyment of life.

The money includes $400,000 for injuries sustained during the incident and $400,000 for damages the jury determined will be sustained in the future.

“This momentous decision brings meaningful closure to an arduous and protracted legal process. Having previously established the defendants, Upchurch Foods Inc and McDonald’s USA LLC, as liable for their wrongful actions, this verdict reaffirms that they must now face the consequences and provide full justice,” the legal team for the family shared.

McDonald’s and Upchurch Foods have not yet commented on the ruling.
