(WBBM NEWSRADIO) — A Boone County, Indiana man won a primary election, despite having been charged with the murder of his wife.

Andrew Wilhoite, 40, of Lebanon received 60 votes in the GOP contest for the Clinton Township board, making him one of three primary winners.

In March he was charged with the murder of his wife, Elizabeth “Nikki” Wilhoite, who had filed for divorce. Friends reported her missing March 25.

Andrew Wilhoite, according to court documents, initially told police they got into a fight and she likely went to visit her sister.

Police say he eventually admitted to hitting her in the head with a flower pot and dumped her body in a creek.

In a Facebook post before her death, Elizabeth Wilhoite wrote, “Where’s my Oscar for acting like everything’s fine?”

Andrew Wilhoite cannot be removed from the November ballot; he would have to withdraw. He could be administered the oath of office in jail. If elected and convicted, however, he would lose the seat.
