The Butler Township Board of Supervisors moved last night to gain greater control over local land use by enacting a "municipal curative amendment" regarding data centers. During the meeting, the board amended its agenda to formally declare that the township's current zoning ordinance is deficient because it fails to define or regulate data center facilities. This strategic legal maneuver is designed to protect the township from "exclusionary zoning" challenges, where a developer could potentially force a project through by arguing the local laws are unconstitutionally silent on the industry.


By declaring its own ordinance invalid, Butler Township has now triggered a 180-day window to draft and adopt comprehensive new regulations. This period essentially creates a temporary moratorium on any new data center applications, preventing developers from "locking in" plans under the old, less-restrictive rules. Township leaders emphasized that this proactive step ensures the municipality has the time to strengthen standards for noise, water usage, and infrastructure impact before any projects are officially proposed.
