(Darien, Conn./WTIC) - The Darien investment banker who says he killed a hotel worker in Anguilla in self defense while on a family vacation last year is now suing the operator of the resort.
Scott Hapgood and his family filed the suit in Marin County Superior Court in California.
It states Auberge Resorts LLC was negligent in the hiring and supervision of the employee, Kenny Mitchel.
Hapgood says he was attacked by Mitchel in his room last April while Mitchel was drunk and high on cocaine.
Furthermore, the suit says that Mitchel was arrested less than three weeks prior to the attack on a rape charge and violated bail conditions.
Hapgood says Mitchel showed up at the door to his room claiming he was called to repair a sink.
Mitchel was subdued by Hapgood and later died.
Hapgood is facing a manslaughter charged. He was free on bail but did not report for a hearing in November on the island, where he is now considered a fugitive from justice.
Late last year, Mitchel's estate filed a wrongful death lawsuit in Hartford against Hapgood.
