
(WTIC-AM) -- A federal judge finds that the company that started building Dunkin' Donuts Park should pay $39-million to an insurance company that paid to complete work on the stadium.
The judge's ruling finds that Arch Insurance Company is entitled to money, because stadium construction under developer Centerplan went over budget, and took so long, that the city of Hartford took Centerplan off the project.
Arch Insurance was then brought in, and spent tens of millions of dollars to finish the overdue minor league baseball stadium.
The insurance company also found problems with the project when it was managed by Centerplan that had to be fixed.
Centerplan argued that several legal agreements related to the project created a contradictory set of obligations, and that Arch Insurance should not have had to pay to finish the project.
The judge rejected this argument, and found that the insurance company acted in good faith.
Centerplan has filed paperwork indicating that it intends to appeal. The company argues that the $39-million dollar amount is not a final amount.
Centerplan is still pursuing a lawsuit against the city of Hartford, and it could try to get the city to pay for any amount it has to pay to Arch Insurance.
The Hartford Yard Goats did eventually begin playing in the stadium, after playing their entire first season elsewhere.
