GRAND RAPIDS (WWJ) – Kent County Prosecutor Chris Becker is expected to announce a charging decision in the shooting death of Patrick Lyoya.

Attorney Ven Johnson, who is representing the family in the case, reportedly called Lyoya's father to let him know the decision will be made during a 3 p.m. press conference Thursday.

The decision on charges will come a little more than two months after the shooting that left the 26-year-old Grand Rapids man dead.

Lyoya was shot in the back of the head by officer Christopher Schurr on April 4 on the southeast side of the city. The officer had conducted a traffic stop on Lyoya, who got out of his car and eventually began to walk away, which led to a tussle that ended with Schurr discharging his weapon while on top of Lyoya on the ground.

An autopsy showed Lyoya was drunk at the time of the shooting, with a BAC of .29 – more than three times the legal limit.

Schurr has remained on administrative leave and stripped of his powers since the shooting.

Michigan State Police have been investigating the shooting and previously asked for patience during the investigation, as detectives were "taking every measure to ensure all evidence and facts are accurately collected and documented."

"We recognize the importance of this investigation, and we are sensitive to the need to complete it in as timely and efficient of a manner as possible," MSP said in a statement back in late April. "As with any investigation, gathering all the facts and documenting every piece of evidence takes time and we appreciate the patience of the community as we work to conduct a thorough and complete investigation."
