Oakland County Sheriff's deputy of nearly 30 years charged with slapping, becoming 'aggressive' with handcuffed suspect

(WWJ) The Oakland County Prosecutor's Office has authorized charges against a Sheriff's deputy, related to an on-duty incident last month.

The Prosecutor's Offices said Kevin McNally was dispatched to WoodSpring Suites in Rochester Hills on a report of a stolen vehicle on November 24.


The caller at the scene near M-59 and Adams said she had been seated in her car when she was attacked by a Shelby Township woman, 35,. The suspect got into the driver's seat and took off to a nearby Meijer, where they did 'burn outs in the parking lot', according to the caller.

Deputies found the stolen car in the parking lot of a Walmart next door. McNally was the first on scene when it was found.

Prosecutors said the suspect was "incoherent" and "appeared to be under the influence of drugs and/or alcohol." After McNally placed her in handcuffs, he attempted to interview her. At that point, she kicked McNally in the groin. He slapped her across the face and "became increasingly aggressive" with her, according to prosecutors.

McNally was suspended the following day amid a probe into the situation by the Sheriff's Special Investigations Unit.

Both a criminal and an internal investigation were conducted. The findings were sent to the Oakland County Prosecutor's Office.

McNally has been charged with Misconduct in Office and Assault and Battery. He is being held on a $5,000 bond. Termination proceedings are underway.

"There is absolutely nothing acceptable about these actions by the soon to be former Deputy" said Sheriff Michael J. Bouchard. "The behavior by this Deputy was wrong and will never be tolerated. The public expects more from law enforcement and the actions did not live up to our expectations or standards."

The woman was arraigned on charges of Reckless Driving, Assault and Battery (on the victim of the Unlawful Driving Away of An Automobile ), and Resisting and Obstructing Arrest. Further charges are pending the results of a blood search warrant.

McNally is a 27-year veteran of the department.
