In new court papers, Governor Greg Abbott is asking an appeals court in Dallas to overturn an injunction because he, the governor, is the commander-in-chief of the state and has the final say on mask mandates.
Last month, State District Court judge Tonya Parker granted an injunction that blocks the Governor's executive order. It was sought by Dallas County Judge Clay Jenkins who has declared a health emergency and ordered masks in all public buildings.
Judge Parker granted the injunction after listening to testimony from witnesses like the mother of a Dallas school child who suffers from a rare disorder who said that she's "really worried" that her daughter will get sick.
The legal papers say the debate is not over the effectiveness of masks, it's over the Governor's order outweighing the local order that Jenkins put in place. No hearing date has been set.
