Judge orders multiple floors be removed from UWS building

NEW YORK (1010 WINS) -- A judge has ordered the developers of a condo tower under construction on the Upper West Side to remove multple floors from the top of a building because it is too tall.

According to a report from the New York Times,  a state Supreme Court ruled last week for the Department of Buildings to revoke the building permit for the tower located at 200 Amsterdam Avenue and remove floors that exceed the zoning limit.


The 668-foot condo tower is nearly completed and althought the exact number is not yet known, developers SJP Properties and Mitsui Fudosan America may be forced to tear down as many as 20 or more floors number from the 52-story luxury tower.

"It's a residential area, it's our home and we don't want to live in shatters," said activist Olive Freud, who started the fight against this building three years ago, claiming it exploited loopholes and zoning laws to add height. "We had to bring land use people and we had to bring in lawyers to find out how this all happened."

An attorney for the developer, Scott Mollen, says they are appealing.
