
NEW YORK (1010 WINS) -- A lawsuit was filed against the NYC Department of Education and Consolidated Bus Transit company by the mother of the third grader who was bullied and slashed behind the ear over a year ago.
Attorney Joe Tacopina says bus officials and staff at Robert F. Kennedy School on East 88th Street in Manhattan ignored the situation. "It's like he was thrown to a lions den. He was supposed to go to school. A litle kid was being sent off to school not to be educated but to be abused, and to be brutalized and beaten."
Three other children identified in sthe suit as “S” and “L and L” were aboard a bus the victim took to and from school, where according to papers, he was hit, punched and teased. The lawsuit also alleges that the matron and school bus driver turned a blind eye.The Daily News reports that the abuse took a bloody turn on December 19, 2017 when “L and L” allegedly slashed the boy’s neck with a sharp object.Photos provided show the bloody cut and the scar behind the victim's ear. “The scar on his neck remains, and upon information and belief, is permanent,” the lawsuit alleges.
Pair is suing the NYC Department of Education, the Robert F. Kennedy School and the Consolidated Bus Transit company for negligence and is seeking unspecified damages.
A spokesman for Consolidated, which operates 166 city school bus routes, deny the allegations and say they'll dispute the boy’s version of events in the complaint.
A NYC Department of Education spokeswoman said school officials will review the lawsuit and take appropriate follow up action.
