Grand jury indicts NJ prison guard for beating inmate, declines to indict for prisoner's death

WOODBRIDGE, N.J. (1010 WINS) — A grand jury indicted a prison guard on misconduct charges for beating a prisoner but declined to charge him for the inmate’s death days after the beating, the New Jersey Attorney General’s Office announced Friday.

Corrections Officer Giuseppe Mandara allegedly broke New Jersey Department of Corrections rules when he abandoned his keys and radio and used “unlawful force” on Darrell Smith, 50, on Aug. 23, 2019, at the Adult Diagnostic and Treatment Center in Woodbridge.

Smith died of a stroke days after the beating, but the grand jury refused to allow the question of Mandara’s role in his death to be considered by a jury. Instead, Mandara will only be tried for official misconduct.

The Attorney General decided to prosecute the incident after an investigation by the Office of Public Integrity and Accountability.
