NEW YORK (WCBS 880) -- The family of a woman killed by an off-duty NYPD officer allegedly angry at her ex is planning to sue police and the city for millions.
The October fatal shooting happened in Bensonhurst, with cops arriving to the scene to find Yvonne Wu, 31, outside of a home where she allegedly confessed that she "shot someone" and that they were inside.
Police said once they entered the home, they found a Jenny Li, 23, who was believed to have once been in an "intimate relationship" with the cop, and Jamie Liang, 24, who cops said now was in some sort of relationship with the Li.
Liang, who was found shot at least once in the chest, was later pronounced dead, while Li survived at least one shot to the torso.
According to the Daily News, a notice of claim was filed on behalf of Liang, planning to sue the city and NYPD for $25 million for wrongful death and emotional distress.
"Clearly the fact that NYPD supervisors allowed Officer Yvonne Wu to retain her service revolver when they were aware of her distressed emotional state raises the issue of negligence in her supervision," said attorney Stanford Rubenstein to the Daily News.
Court docs claim the city knew of Wu's "mental health issues" but continued to let her have a service weapon.
Police called the case domestic in nature, saying that all three had previously known each other. The house belonged to Li.
The officer and the surviving victim apparently dated for two years and before breaking up, according to the New York Post. Cops believed Wu was in the home before the two victims arrived.
The gun used in the shooting may have been the officer's service weapon, police said.
Wu, who was assigned to patrol Borough Brooklyn South Precinct, was taken into custody and was brought to a hospital for an evaluation, police said.
