Former ROTC student sues Fordham University for failing to stop repeated rape by roommate

NEW YORK (1010 WINS) — A former student at Fordham University in the Bronx filed a lawsuit claiming the school failed to act after he was raped by his roommate, who then sexually assaulted him again.

Frank Austin, who is now 32 years old, was a Navy ROTC student when he was first raped by his roommate in February 2011, according to the suit.

He allegedly reported the incident to school staff, who did “absolutely nothing,”  Austin told NBC New York.

Austin repeatedly tried to switch roommates as the man who had attacked him became increasingly volatile and violent. The school failed to extricate him, and Austin was raped a second time, the litigation claims.

The lawsuit seeks unspecified damages from the school for negligence.

It was filed under the Adult Survivor’s Act, a New York law that temporarily allowed sexual assault victims to sue in cases that had exceeded the statute of limitations.

Austin had filed a similar lawsuit in 2021, but it was thrown out due to the amount of time that had passed.
