NY state Sen. Luis Sepulveda has domestic violence charges dropped: lawyer

NEW YORK (WCBS 880) -- Prosecutors have reportedly dismissed domestic violence charges again Bronx state Sen. Luis Sepulveda.

The case against Sepulveda was dropped and sealed Monday, his lawyer told the New York Post.


Sepulveda was hit with assault, harassment and criminal obstruction of breathing charges earlier this year after his estranged wife Elizabeth accused him of choking her. The state Senator turned himself in to police and was free on bail while denying the allegations, according to the report.

An argument escalated to a physical fight, and when police arrived, both Luis and Elizabeth claimed the other had assaulted them, according to the New York Times.

The senator's attorney Marvin Raskin told the Times that the accusations were a "calculated attempt by a disgruntled party" back in January.

Sepulveda's wife reportedly lived in Florida with the pair's son, and was visiting at the time of the incident.

According to the report, the argument started over the senator removing Elizabeth from their joint bank account.

Sepulveda was removed from all of his committee assignments by state Senate Majority Leader Andrea Stewart-Cousins in the wake of the allegations.

Sepulveda was among a handful of candidates running for Bronx borough president at the time of the allegations. He remained in the race but only garnered the fourth-most votes in the Democratic primary, which was won by Vanessa Gibson.

The state senator appeared alongside state Attorney General Letitia James for an opioid epidemic settlement program Monday.
