NEW YORK (1010 WINS) – A Queens woman filed a lawsuit against the NYPD and New York City this week, alleging that an off-duty officer recorded their sexual encounter and threatened to share the video if she spoke about it.
Valentina Veleva, 35, filed the lawsuit on Tuesday, according to the New York Post. She's seeking unspecified damages.
The suit stems from an incident on March 14, 2017, in which Veleva alleges officer Miguel Delacruz recorded her giving him oral sex at his Jackson Heights apartment without her permission.
Veleva alleges that Delacruz, who is married with a child, sent her a video clip of the encounter when she contacted him the next morning and that he texted her, "Got more (pornographic clips)."
According to court papers, Delacruz allegedly told Veleva "he had cameras in his apartment and that he had recorded Valentina."
Veleva told the Post, "I was embarrassed, but mostly I was scared because you know how something like that can circle around on the internet."
Veleva reported the incident to the NYPD and Queens District Attorney's Office but Delacruz has not faced a charge of unlawful surveillance, the court docs allege.
Veleva's lawyer, Joe Murray, told the Post, "It is disgusting how the NYPD and the Queens DA mishandled this case from the beginning, and they continue to victimize this young lady by refusing to take her complaint seriously."
A spokesperson for the Queens DA told the Post, "We take every complaint of this nature very seriously, and Ms. Veleva's was no exception. This matter was thoroughly and carefully reviewed before investigators determined there was insufficient evidence to proceed with a criminal case."
The city Law Department told the Post it's reviewing the case.
A lawyer for Delacruz hadn't returned a request for comment by the Post.
