NEW YORK (1010 WINS) -- A prosecutor who resigned last month after the Manhattan District Attorney dropped a criminal case against former President Donald Trump described failure to pursue charges as a ‘grave failure of justice’ in a resignation letter obtained by The New York Times.

Two prosecutors, Mark Pomerantz and Carey Dunne, resigned after Manhattan DA Alvin Bragg dropped a case against former President Donald Trump for falsifying business records — a felony in New York State.

“The team that has been investigating Mr. Trump harbors no doubt about whether he committed crimes — he did,” Pomerantz wrote in his resignation letter.

Pomerantz, a 70-year-old former federal prosecutor, came out of retirement to work on the case.

He believed the state could prove Trump knowingly inflated the value of his golf clubs, hotels and office buildings in order to secure bank loans.

Bragg wanted to wait for further evidence before bringing criminal charges.

The district attorney’s investigation continues despite the resignations, and Bragg cannot comment, because the case is ongoing.

In his letter, Pomerantz said he thought failing to act hurt the likelihood that Trump would ever face consequences for the alleged crime.

“I and others believe that your decision not to authorize prosecution now will doom any future prospects that Trump will be prosecuted for the criminal conduct we have been investigating,” said Pomerantz.

Had Bragg pursued the case, Trump would have been the first American president to face criminal charges.

New York Attorney General Letitia James is investigating the same matter and filed court documents claiming to have evidence that Trump falsified documents. Her investigation is a civil matter and could lead to a lawsuit but not criminal charges.
