Queens man gets 11 and a half years in prison for shooting off-duty correction officer

NEW YORK (1010 WINS/WCBS 880) – A man was sentenced Thursday for shooting an off-duty correction officer in a Queens shootout during the summer of 2022 while his co-defendant awaits sentencing, the Queens District Attorney’s Office said.

Mark Gibbs, 24, pleaded guilty to criminal possession of a weapon last month and was sentenced Thursday to 11 and a half years in prison followed by five years of supervision after his release.

Gibbs’ co-defendant, Sevaughn Green, 21, will be sentenced on Dec. 11.

At 8:03 p.m. on July 3, 2022, David Donegan, an off-duty correction officer, saw a dispute at the intersection of 214th Place and Jamaica Ave, officials said.

Donegan watched Green approach another man and try to punch him in the face, prompting him to approach and try to break up the fight.

Green went over to Gibbs and grabbed a gun from Gibbs’ waistband. Gibbs then grabbed a gun from his crossbody bag and started shooting at Donegan, the district attorney’s office said.

Donegan turned away and was struck in the calf. He then pulled out his licensed firearm and shot back, hitting Gibbs three times in the torso, authorities reported.

When Gibbs fell, Green crouched near him and shot toward Donegan.

Donegan continued returning fire and and struck Green in the leg.

“This kind of reckless gun violence has absolutely no place on our streets and we will not let up in our efforts to end it. We applaud Correction Officer Donegan’s extraordinary bravery and commitment to protecting us,” Queens District Attorney Melinda Katz said.

Donegan was treated for his gunshot wound at a local hospital, and no pedestrians were injured in the shootout, officials said.
