NEW YORK (1010 WINS/WCBS 880) -- A New Jersey man was sentenced to up to nine years in prison on Oct. 12 after being convicted of smashing a woman's car window with a golf club and striking her directly, causing injury.
Following a three-day trial in July, Aiven Rosario, 26, of East Orange, was convicted of two counts of aggravated assault, one count of simple assault and one count of criminal mischief, according to Lancaster County DA's Office.
Rosario followed the victim into a parking lot – claiming that the victim cut off his and his mother's vehicles – and used a golf club to smash the victim's car window before bashing the victim in the head, officials said.
The assault occurred at 9:52 p.m. on March 6, 2021, in the 1400 block of Millport Road in West Lampeter Township, PA.
The victim suffered a traumatic brain injury and has been undergoing treatment since the event.
During the sentencing hearing both the victim and victim's boyfriend recounted the variety of physical and mental traumas and work difficulties the victim has faced in the aftermath of the assault.
Rosario spoke during the sentencing and apologized to the victim before claiming that he acted out of fear.
Lancaster County Judge Jeffrey Conrad – who sentenced Rosario to four and a half to nine years in prison, plus a restitution fee of $34,992 – responded "I don't think that you did what you did out of fear, I think you did what you did out of anger."
