If we had to pick a state where the most frivolous lawsuits get filed, it has to be Florida, right?  Florida is where Florida Man lives after all.

Well, this isn't a tale of a Florida man, but a Florida woman who has filed a lawsuit against Hershey over their popular Reese's Peanut Butter pumpkins that come out every Halloween.  Apparently, they aren't cute enough.

More specifically, the woman has filed the lawsuit claiming the company "falsely" represented some of its Reese's Peanut Butter products.  The woman states that Hershey products were "falsely" represented as having "explicit carved out artistic designs" when the candy itself doesn't have much of a design at all.

According to WTSP, the woman says that Hershey violated Florida's Deceptive and Unfair Trade Practices Act, and is seeking damages worth $5 BILLION!  The woman reportedly bought the bag of chocolate at a store for $4.49.

The Hershey Company has 21 days to respond to the suit.
